My question involves criminal law for the state of: Missouri
BACKGROUND: My husband (hopefully soon to be ex-husband) is a convicted DUI felon in the state of KANSAS. He has done his time and probation, so he may legally drink again. Because of all of the problems his drinking has cost our family, I told him if he ever drank again, I would divorce him.
About two weeks ago, I found an empty vodka bottle in the garage. I had my suspicions he was drinking again, but there was no proof. Because I had caught him hiding booze in his truck, which is IN MY NAME ONLY, I went down and looked around for his stash. When I opened the storage box between the seats I saw a little pistol. I got very scared then. I also saw a box of bullets on the floor behind his seat.
I think his mom gave him the gun because it belonged to his dad.
I looked up the Missouri statute regarding weapons violations and his DUI conviction is equivalent to a class C felony in MO, so he is breaking MO law.
My QUESTION is, when I turn him in, will I BE HELD LIABLE for the gun being in the truck? I can't even drive it because it is so big, and I haven't ridden in it in months.
I don't know if the gun was loaded. I don't even care. We have a daughter who is a toddler and he's always carting her around in the truck. His irresponsibility and complete disregard for the law really tick me off.![]()
