    Question Client Docking Paycheck

    My question involves independent contractors in the state of: Texas
    I'm an independent contractor with a computer service company. Quite often the firm will send a different technician/contractor to a home or business within a few days of the originating service call and consider it a warranty service or 2 touch. Maybe the customer had an occurrence of the original problem or something wasn't completed whether by contractor incompetence or the customer not mentioning the problem at the time. Anyway, there is no charge for that second or sometimes third trip but that 2nd or 3rd contractor is paid by docking the first contractor's next paycheck. Is this legal? There is no official procedure in place, no papers are signed and most of the time the originating contractor isn't even notified that his or her paycheck is being or has been docked. Let it be known that I don't think the computer service business has any place hiring a staff of all contractors to begin with. Thank you for your time.

    Assuming you are legitimately classified as an IC, terms of payment or recovery should be controlled by your contract/agreement. If so, and the company is in breach of the agreement, your recourse is small claims.

    Actually I've been working there for 3 months and the only thing I've signed is the IRS form and a "vanilla" IC form, both last week. What does that mean then if the only agreement is that I'm an IC with no specifics?
