    Default Caught Shoplifting Macys in California

    I am 19 years old. Shoplifted for the first time in macys and got caught. I'm an idiot, I don't know why I did, I thought I could get away with it but failed. Never going to do it again. I was caught and admitted for shoplifting.

    The merchandise cost the LP put was $77 dollars although it was on clearance for $28. They did not call the police, no fingerprinting or anything. I am BANNED from the store for 3 years. They took my picture and information. I asked a bunch of questions, whether this will affect my criminal record in getting a job in the future, the LP said "no this is only in the Macy's system" but I don't believe that. So that's why i'm asking all of you.

    I have a few questions:

    1. Aprox. how much would my fine be?
    2. Will I be going to court?
    3. How much will this affect my future? Pertaining specifically to getting a job.
    4. Will this also be considered a "conviction" or crime when job applications asks if I've done that.
    5. Should I write a letter of apology?
    6. Where in my record will this be in? Is it possible for me to have it removed? Or am I stuck with this nasty record forever.

    I'm nervous. I WILL NEVER shoplift ever again.

    The fine is called a Civil Demand. The amount depends on State. Usually around $250 minimum. And yes, the law takes into account the full retail value of the item, not sales or clearance prices.

    2. Will I be going to court?
    Bear in mind, the store does have 1 year to file Criminal Charges. Since no police have yet been involved...count your blessings.

    HOWEVER - if you don't pay that Civil Demand immediately - the chances of the store filing Criminal Charges increases big time...not to mention they can raise the amount, sue you for the money plus attorney fees, and screw up your credit rating....


    3. How much will this affect my future? Pertaining specifically to getting a job.

    - Since cops have not been called...at worst, you may be entered into the National Retail Theft Database. So that may affect Retail jobs during a Criminal Background Check.

    4. Will this also be considered a "conviction" or crime when job applications asks if I've done that.

    Unless police charge you...you should be able to honestly answer that you have never been charged or convicted of a misdemeanor.

    5. Should I write a letter of apology?

    Sounds like a nice idea, but no. That could be used as an admission of guilt if the store does decide within a year to file criminal charges.

    6. Where in my record will this be in? Is it possible for me to have it removed? Or am I stuck with this nasty record forever.

    Too many factors to tell you....again, the store had 1 year to file charges. If they don't, then consider yourself very lucky. Definitely stay out of ANY Macy's for that three years. Again, your record may appear in the National Retail Theft Database....it may not....

    If you do get charged criminally, your best bet is a consultation with a Criminal Defense Lawyer (many offer free consults).

    1. A civil demand ranges in the hundreds but no more than $500. However, it depends on the state, so the amount may be higher than $500. Pay this as soon as possible or the store will sue you and the amount will double or even triple.
    2. The store has a year to file criminal charges against you.
    3. Don't apply for jobs that involve $$$$$$
    4. Not unless the answer to #2 happens first
    5. No.
    6. Not unless the answer to #2 happens first

    Also, don't enter the store again for 3 years or you will face a trespassing charge.

    Thieves always pay full price. So all those 50%-75% off Sales that are surrounded with limited time only signs are not meant for lifters. Stores like Macy's and JCPennys that have their home brand at "major discounts" pretty much all the time will really rack up when you get caught. I saw a kid get caught for shoplifting 8 clearance xbox 360 games. Some as cheap as 2 bucks on clearance however his overall charge was about 400 dollars. If he would have just bought them it would have been under 80 dollars. Then the fine for felony charge and the civil demand and the lawyer....bla. What a mess...
