    Unhappy Receipt of Stolen Property

    My question involves criminal law for the state of: TEXAS


    Today I found out that the 28" LCD TV that I pawned was reported stolen. I had no knowledge of the TV being stolen as I received it as a Mother's Day gift last year from my now ex-boyfriend. I pawned the TV because I got laid off from my job and needed some extra money to make ends meet. Now I'm wondering what will happen since they have my name in the database as pawning the TV? I've never been arrested before or jailed and I've never stolen anything before in my 33 years of life. What do I do? I haven't been contacted by the police or anything but it just really bothers me that the TV was reported stolen. Can charges be pressed against me? How do I clear this mess up?

    well, if you had no knowledge it was stolen or reason to believe it was you technically are not guilty. If the police want to talk with you, I would suggest engaging an attorney before you answer anything. Sometimes the innocent do need to be protected, sometimes from themselves even.

    some people will say to simply be honest with the police. While usually that will not get you into trouble, it almost never gets you out of trouble and does occasionally get you into trouble. In todays world, I simply suggest not saying much of anything without an attorney to help you not hang yourself.



    did you see the Salahi's on TV in front of Congress the other day? They would not even answer a direct question of "were you at the Whitehouse on <such and such date>?" While there is photos and videotape to prove they were there, there is no chance of denying they were there, they have an absolute right to not incriminate themselves by saying something that would lead to any charges.

    Thank you for responding to my thread. I have considered contacting a attorney but my money is very limited. I just want to know if I should say nothing and wait for and if the police should try to find me or contact me or should I try to find what police department is handling the stolen property? I don't want to do anything to incriminate myself. Texas is a big state and I'm just wondering if they would follow up on me? Again, I've never been intro with the law and I don't have a record. I don't want to start having a record now either. I just know im innocent and I did nothing wrong except for pawn a TV that I didn't know was stolen property. UUgh I'm so angry.

    well, if you took the tv to the pawn shop, more than likely they are going to pay a visit to you. Who else would they look for?

    so, how did you find out the tv was stolen?

    I found out the TV was stolen when I called the pawn shop to let them know what day i would be in to pay off my loan and get what I thought was my TV back since the final date had past. When i gave the pawn shop worker the ticket number to look up my account to make sure they had not pulled it off the shelves he then informed me that the TV wasn't there and it had been taken by the police because the serial number came back stolen. So of course I said excuse me? Stolen? He said yes the serial number came back that this TV was reported stolen. I mean this was a mother's day gift to me last year so I had no idea it was stolen.

    Well thanks for your input. I have contacted an attorney and I'm actually putting her on retainer. She advised me what to do and what not to do. The one thing i shouldn't do is talk to the police without her if I'm contacted. So I'm definitely will get this matter cleared up because I did NOT steal anything.

    While I did not post it, in my mind I was quite condemning of the ex-BF. I realized that with just the info your provided, that may have been very undeserved. He too may have been ignorant of the situation as well. If that is the case, not saying anything to the police would be good for him as well. If he is guilty, it would not bother me for him to be held accountable but given the possibility he isn't, he should protect himself as well regardless of your personal situation now.

    It isn't fair an innocent person (if they are truly innocent) be held accountable for the crimes of others.

    Almost assuredly this will go to him after contact with you so if you have any relationship with him and believe him to having been unwittingly involved with the theft, you might give him a heads up. Be very cautious what you do say as that alone could tend to prove some complicity in a crime for you if he is in fact the guilty party.

    Maybe a word from your attorney would be best.

    Thanks I've already taken that into consideration. I plan on not going down for this as I know I did nothing wrong.
