    Default Will They Accept a Check That Says "Not an Admission of Guilt"

    I have to pay my civil demand with check or money order. I want to write on there "not an admission of guilt". Do you think the place will accept the check or money order with that written on it? Thanks. (State of New York where shoplifting is even done by the rich and famous in the posh stores. I am not one of them but they put it in the paper all the time the rich people getting busted for shoplifting in high class stores, including many celebrities that live in NY! I don't know if the news goes nationwide but it does make the NY papers. Numerous times I have seen famous people get busted in NY for shoplifting as it is in the local NYC papers.)

    Why does it matter what other people do?

    it doesn't matter what you write on the check for two reasons.

    One, because your missive is not legally binding.

    Two, because you wouldn't have received the civil demand unless you had already signed an admission of guilt at the retailer when they caught you.

    Saying, "I didn't do it" now is not going to matter much.

    They'll cash it even if you write "You cannot cash this unless you acknowledge that I AM SPARTACUS!" That does not preclude them from prosecuting you if they choose to do so, or listing you in the National Retail Theft Database.

    The endorsement holds no legal weight at all. It's meaningless.

    You are correct... that was poorly phrased.

    There had to be SOME exchange of information or else the CD wouldn't have found the OP.

    Usually, that information is included upon the standard form outlining the theft, the thief's name and address and the legality of the civil demand.

    I assumed that this form had been used. It is, of course, perfectly possible that it was not.

    Given that payment of a civil demand is not an admission of guilt, I don't see why anybody would reject your check on the basis that you state as much in the memo space.

    While that statement has no legal standing as others have said, so you COULD do it, I'd recommend that you don't do it. It doesn't help you in any way and may irritate people needlessly.
