Default Shoplifting from a Colorado Walmart

Sometime last week one of my best friends were caught shoplifting from Walmart by some kid that works there, "undercover" he said. At that point he tried to give the items back to the "undercover" and the "undercover" kept telling him that he had to come with him to the security office. At that point my friend said, "I can't afford to" and tried to walk out of the store at which point the "undercover" grabbed him and started to wrestle him to the ground. My friends car keys fell out of his pocket and another employee took the keys and said, "now i have his keys so he cant leave." At that point my friend stopped trying to get to his car and was taken to the security office.

I was forced to wait outside during the whole time he was in there which was about 30 or 45 minutes. The police showed up about 30 minutes after he was in there and then about 10 minutes after that they released him. He told me what had gone on inside of the office.

What he told me was of no surprise. He told me that they called the police because he resisted. The employee didn't press charges because my friend never tried to assault to him or harm him in any way, he was only trying to get passed him. The police gave him this blue sheet of paper that said he has to go to court and there they will give him his sentence.

My friend doesn't have internet and i am slightly concerned for him so i decided to ask this for him. He has never done this before. He is also quite scared about the outcome of this. He was also wondering if this would go on his record or not. He has never done anything before that involved him to go to court that has to go with criminal charges. He has had a few traffic violations but that is the extent of his record. He is a good guy but just stuck in a very bad spot right now and has a lot of money problems. The total amount of the items he was trying to shoplift was less than $2. He is 23 years old. He told me he was being very co-operative in the office and they helped bandage up his knees because they were pretty badly scratched up he was trying to get to his car. I also had no idea that he was trying to steal anything from the store up until he was stopped.

Any help would be greatly appreciated.

Tell your friend to expect a civil judgement in the mail. His desire to not pay for a $2 item may cost him a few hundred dollars in a civil judgement, as well as criminal penalties.

Tell your friend to buy a lottery ticket because he’s lucky…very lucky!

It’s extremely rare when wally world doesn’t press charges after a physical altercation.

If i'm reading this correctly wal-mart did charge him. They just didn't charge him with assault or robbery. He got lucky in the sense that he was charged with a misdemeanor and not a felony. Dollar amount doesn't become as relevant when you fight. So it's going to be a lot more than few hundred dollars. Maybe $500-$1000 depending if he's going to hire a lawyer or not. Civil demand + fines will equal out to at least $500 dollars.
