    Default Violation of a Deferred Sentence - What Will Eventually Happen

    My question involves criminal law for the state of: Florida

    In December of 2008 My half-sister damaged my car upwards of 1300 dollars. The officer arrested her at the scene. She was 17 years old at the time and taken to JAC, we're in Florida. She was released and a court date was set in January. She failed to appear. I was not notified until May. I called the police on her and she was arrested and held for 3 days and then released again and another court date was set. She attended a few court dates and was offered a diversion program and ordered to pay restitution. She failed to complete the sanctions of the program and was refiled on. I was summoned to court but never had to appear because of a plea offering. She never appeared for that and currently has a pick up order out for her arrest. During this time she was arrested for possession of a controlled substance (felony) and later arrested as an adult for domestic battery. She has also failed to appear to court dates for those offenses as well.

    What will eventually happen with this case?

    Sis will be incarcerated. In addition to committing an assortment of increasingly serious crimes leading up to a felony, she's a scofflaw. She's gone beyond "trying to court's patience" and is now in the zone of "seriously pissed off the court."

    I don't know the charge she's facing. The woman I spoke with only told me her charges. I know the damage to my car is a felony as it exceeds $1000 and then she added the drug possession was felony but nothing more concerning that. I just want to know if I'll even see a dime of my restitution or if she'll be arrested without being released this time.

    I wouldn't bet on getting any restitution for awhile. I wouldn't expect her to be released without posting substantial bail, at least.

    And that's the problem I'm starting to have with all of this. She keeps getting bail but continues to fail to appear. That's what's keeps my case tied up. Will they eventually just hold her until the next court date? She recently spent a week in jail for failing to appear on her adult case. She had a history of failing to appear prior to that but was still given bail...

    Eventually the court will get tired of her failing to appear, and just hold her until the next court date. When that will happen is anybody's guess.
