    Default Domestic Battery Charges in Nevada

    My question involves criminal law for the state of: Nevada

    I am a female college student with absolutely no criminal record record, I've never been in serious trouble at school or outside of school, and I participate in community service (Big Brothers Big Sisters) every week. Last month, my boyfriend and I got into a huge arguement. We were outside. I was drunk, he was drunk, and I am underage. Some girl called the police on us for being too loud. She was really aggrivated and rude, and she ended up hitting me. I got a black eye. I was already upset with my boyfriend and since he didnt help me, I hit him. This was when the police were pulling up, so they saw me hit him. They arrested me for a domestic battery misdemeanor. They did not press charges about being underage and drinking. I spent the night in jail.

    I have court tomorrow and would really appreciate any brief advice on what to say, not to say. My boyfriend is going to be with me. I couldn't afford a lawyer, and my parents also told me I wouldn't need one. I'm really hoping this is true.

    This arrest has impacted me TREMENDOUSLY and am terrified of spending any more time in jail.

    You will probobly need a lawyer or a public defender. I know some people here will disagree but if neither of you are willing(well him mainly) to participate in helping the prosecutor to carry on this case, they can only do so much with it. They might offer you a disorderly conduct but there's a good chance no ones gonna want to take a case to trial if the statement is from an eyewitness and the victim is absent. I guess they might subpeona the girl who hit you to build a better case against you. I'm thinking they will try to stick you with disorderly conduct afterall.

    You defintely want a lawyer b.c domestic battery is bad to have on your record, a reduction would help but can still hurt you. Sometimes they will still see the orginal arrest and charge. If the case gets dismissed it would look more favorable to you.

    A lawyer fighting for a dismal or reduction to disordely conduct is in your best interest,you should plead not guitly and ask for a legal aide. A dv conviction can prevent you from having a gun,also many employers will take the charge very seriously.
