    Unhappy Partition of Property

    My question involves real estate located in the State of: Texas

    I would like some advise on a potential problem I have concerning a property that I am co-buyer. In 2001, my grandmother gave my mother money to purchase a condominium for her to move into but my mother and I put it in our names. We owe less than $15k on it. My mother paid the mortgage for a 6 years and I have paid for the last 2 years. My mother has threatened to sell the condo over a dispute and wants to have any money she has put into the property paid to her...What legal right, if any, does she have to do this? What money would she be legally entitled to? Does my Grandmother have any rights since she gave the majority of the money to purchase the property? Please help if you have any suggestions.

    As a co-owner, if she wishes, she can commence a lawsuit for partition and sale. From what you've stated, with you and her on the title as equal owners, she would appear entitled to half of the equity. I don't know what agreements she would concede, or what evidence you have of unequal ownership or in relation to your grandmother's investment (something mom could claim was a gift).
