    Default Response to Mothers Petition for Monitored Visitation

    This deals with a petition filed by my childs mother for supervised visitation, in Indiana


    I received this petition, and it claims that I said things to my child about the mother. Which I did not.

    It also claims I have a extensive criminal history, and they named off several crimes, yet I only have a PI arrest from college.

    They claimed I had several alias's? All I know of are different names on my credit report, and perhaps screen names used on forums like this?

    Something about transient lifestyle? Because I have lived at different addresses over the past 6 years? Actually a total of 3, average time at each 2 years, and all with in 5 miles of each other.

    I do not have a lawyer, although I have applied with the local legal aid society, can my ex and her lawyer just make stuff up like this?

    Is there anything I can file to challenge this?

    Do I have any recourse for them making these false claims?

    The burden of proof is upon your ex, not you.

    What are your current orders?

    I just have a few hours one night a week, and every other weekend, but nothing for holidays or special school time off.

    I requested more then what I got, but I am glad I got what I did.

    You can file a response denying any of these claims. It's your word against her, and depending on who the courts believe. They most likely will have to prove the alias, criminal charges, etc but the fact that you talked bad about mom is hard to prove...

    Unless you've done something horribly wrong, I dont' think it's outrageous for you to ask for every other holiday and some time when the kid is off of school.
