My question involves a background check in the State of: IN

In September of 2009 i was ticketed for possession of marijuana. this has been and still is the first time i've ever been in any sort of trouble. i plead guilty in court in order to be entered into the conditional discharge program. received one year of unsupervised probation, and had to take a drug and alcohol assessment course. in one year time, from court the date, if i've completed all terms of my probation the charge will be dropped and i will not be convicted of the misdemeanor.

now onto my quesiton. I am currently applying for a new job, and the online application is to the part where i have to answer this:

Have you ever been convicted of, or plead guilty to or no contest to, a felony or misdemeanor, including DUI's and DWI's? This would not include minor traffic violations or a case that has been expunged, sealed, dismissed, erased, pardoned, or impounded. If yes, explain below. NOTE: Answering yes will not necessarily disqualify an applicant from employment. Factors such as age and date of the offense, the seriousness of the violation and rehabilitation will be considered.

with a simple yes or no

sorry if this seems to be an easy question to answer but i just want to be honest during the application process. do i answer yes or no? again, sorry if this seems like a pointless question, but i'm wanted to get all my ducks in a line before continuing with the application.

i tried calling my probation officer to ask her about the above question, but today being MLKjr day, they are not in the office today.

thank you for your time
