In 2005, my husband (a Mexican national) was living illegally in the US in New Jersey. He applied to adjust his status after marrying me (a US citizen) and was denied and given a 10 year bar. He was deemed inadmissable under the following sections: 212(a)(9)(B)(II) and 212(a)(9)(C)(I). We have been living in Mexico since 2005. I never applied for a hardship waiver because I didn't think I could get one. Now that we are half way through this bar, I'm starting to think about what will happen after. What are the chances that he will be able to get his VISA after the 10 years? What do we have to do to start the ball rolling on that and when should we start? By the way, we have a 2 year old daughter now who was born here in Mexico. Thank you very much.
