    Default Didn't Steal but Stopped Anyway

    My question involves criminal law for the state of: North Carolina

    Okay, so yesterday I was in a large department store and I was walking around. When I left the store I was approached by this woman and she said she was with store security and that she wants me to come with her because she saw me steal something. I told her I didn’t steal anything, which I really didn’t. She said she say me take a watch, but I placed it back on the shelf. I told her to piss off and that I was leaving, she stood in front of me and tried to block me but I pushed through her, then she grabbed me and tried to wrestle me to the ground. I was scarred for my life so I took a pen out of my pocket and stabbed her a couple times to get her away from me. After she fell to the ground I ran away. I feel really bad but I didn’t do anything wrong so why did she try to stop me. I was wondering if I will be in any trouble because I was just defending myself. If she would have let me go I would not have use the pen as a weapon. I am a really good person never in trouble, I kinda freaked out, but hopefully everything will be ok because she was the aggressor. Should I go to the police to file assault charges on her because she assaulted me first. Please let me know of any advice you have.

    You could be charged with a crime as a result of your actions, such as aggravated assault. I suggest you consult a criminal defense lawyer.

    You should expect that the police are already aware of this incident.

    Best advice? Shut Up and stay low. Hopefully the police won't find you and nothing will happen. Under no circumstances should you file a police report. Store security has the authority to use physical force in order to stop a shoplifting, you however do not have the right to fight back.

    You freaked out...but still had the sense to find a pen for a weapon....

    Not gonna look good in front of a judge. Same with the "Piss off" remark and attitude.

    If you were innocent, why fight the LP? Why not cooperate?

    You were scared for your life? How? Why? I don't see any mention of LP pulling a knife or gun, jumping out at you from behind bushes in a dark parking lot?

    Wow. You're brave. I just yelled at the employee for wrongly accusing me of something that I didn't do. I hope the LP person doesn't recognize you and file charges against you. Then again, if there's no footage containing the fight, then there's no proof that you did something to the LP person.

    Yeah, no proof except the stab wounds and the LP's testimony. What is it with people thinking video=proof. People have been charged and convicted of crimes for hundreds of years before video existed.

    I want to make one thing clear, here.

    The first person to get physical wasn't LP but the OP... when she pushed by a person legally authorized to stop her.

    You don't stab someone because they grab your arm... jeez.

    How would you feel, OP, if she had started stabbing YOU when you pushed her away?

    You weren't in fear of squat.

    Now that you mention it, the OP may take a picture of the stab wounds and describe the person.

    I thought videos can be used as evidence to back up what the person is saying or doing.

    if you did not steal anything. and she touched you physically in any way. then she assaulted you. if she did not touch you first, and you touched her first(EVEN THOUGH YOU DID NOT STEAL) then you're screwed.
