I rcvd a demand for payment because my daughter was busted shoplifting 2 months ago- I have read thru alot of the posts and I still need to understand the CA penal code--the way I read it, I dont have to pay if the merchandise was recovered, undamaged... can anyone clarify and hel explain if i am correct..her is the part of the code I am referring to:
(b) “The parent or legal guardian having control and custody of an emancipated minor whose conduct violates this subdivision shall be jointly and severally liable with the minor to the merchant for the retail value of the merchandise, if not recovered in merchantable condition, plus damages…”
(c) “…the adult or emancipated minor shall be liable to the merchant for damages of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00), in addition to the retail value of the merchandise, if not recovered in undamaged condition, plus costs.”
I dont mind paying the actal amount of the merchandise she took, which was $80, but they want $375...and beleive me, Im all for teaching a lesson, but this is not teaching her, this is coming out of my pocket!! please help me understand this penal code.
