    Default F1 Visa Overstay - Traffic Ticket

    @ Miami, Florida

    This is my current status:

    1. Valid Passport (till 2014)
    2. The student visa (F1) stamp on the passport is till August 2010 - 8 more months
    3. I have a SSN card that says - Work with DHS authorization only. Received this when I started working in the school I was enrolled at. (International students can work for 20 hours a week on campus.
    4. I94
    5. Expired i20.

    I entered the country on these basis and enrolled for classes from 2005 till 2008 spring. Since then I have not enrolled in classes and I am sure to be 'out of status' since I have not been continually enrolled as a full time student.

    Now on the second of January, 2010, I got pulled over for driving my uncle's SUV because of an expired tag and the cop found out that my drivers license is expired. He could have arrested me on the spot and taken me to jail. Instead he said he was not going to do that and wrote me 7 tickets. He asked me to book a court date to clear it up. The very next day I got the tag fixed. However I cannot get my drivers license because of my expired i20.

    When I call to book a court date, will it be noticed that I am an overstay despite not being arrested. I possess all the other documents except for my expired i20 form which if looked at will betray the fact that I am an overstay though my student visa covers me for a while. Can I safely attend the summons? Or will there be some sort of background check and will that information be passed on to ICE? Please let me know what my options are.

    They don't check your visa status for traffic court.
