    Default Filing I-485 Separate from the I-130

    I am a U.S. citizen married to a French citizen. My wife is trying to become a permanent resident. I filed an I-130 a few months ago along with the related forms (G-325, photos, etc.). I only later realized that I also need to submit an I-485 (and an I-131 since we would like to travel).

    I have two questions: 1) When I submit the I-485 should I re-submit the related forms (e.g. the G-325, etc.) that were part of the I-130 application? 2) If my wife can claim me as a dependent, do I need to submit an I-864a application (she has no accompanying dependents)?

    1. YES you should submit it again when filing the I-485.

    2. you must be the primary sponsor of your wife therefor you should submit
    form I-864. if you don't make enough money and you need a co-sponsor
    you can put down your wifes income. in this case each one of you needs
    to file I-864

    form I-864A is for a household member who is not a sponsored immigrant, that agrees to make his or her income and/or assets available to the sponsor to help support the immigrant for whom the sponsor has filed an affidavit of support.
    if someone else lives with you and that person is going to be the co-sponsor than that person files both I-864 and I-864A
