    Default Reduction or Correction of Fines

    My DH was given probation and a ton of fines and costly classes and counseling for a DUI. He was represented by a Public Defender. When he was in court the State's Attorney said the fine was supposed be $500 plus court fees. After leaving court and reviewing the papers, the fine charged was $1000 plus court fees. My dh brought it to the PD's attention and she agreed he was right. We asked to bring it to the judge's attention but she just blew him off. It has been about 7 months later. My husband has been out of work and can no longer afford these fines at this point. He has paid about half of the fines up to this point. Is there anyway 1) it can be corrected. 2) Possibly ask the judge to dismiss the reaminder of the fines due to circumstances?

    The fact that the court ordered a penalty above the public defender's estimate does not of itself mean that there was an error. The court can order the fine it deems appropriate within the confines of the law.

    If there was an error, have your husband call his lawyer again and inquire about it.

    Meanwhile, if your husband expects to have problems meeting the terms of his probation, he needs to discuss the problem with his probation officer before he ends up with a violation.
