    Default UI Eligibility for Employee "Contracted" for Certain Time Period

    My question involves unemployment benefits for the state of: Texas

    I am currently working as a full-time, official employee for a company, but due to budgetary reasons, they have told me that my last day will be in a few weeks.

    When I was hired, I was told that I would be promised a position for 6 months, and that after that time we would reassess based on their budget, etc. They were extremely happy with my work, and the only reason they cannot continue to employ me is because of finances. I never signed any sort of consulting contract or document stating my employment term, and I am paid as a regular employee with all taxes being withheld.

    Also, prior to this job, I have had continuous employment; I have received wages as a regular employee with other companies for the past 12+ quarters.

    Is an employee in this type of situation legally eligible to file for and/or possiblly receive UI benefits?

    There are no circumstances I can think of under which it would be illegal to file for UI. You may or may not get them depending, but there is no law I've ever heard of that prohibits you from making the application.

    I don't see anything in your post that would suggest that you would not be eligible for benefits.

    I don't either. You ARE being paid as an employee, not an independent contractor, correct?

    Correct. Full-time regular employee with full benefits, all withholdings being taken out of my check, etc.

    I have no idea where I got it into my head that I couldn't qualify - I think I was taking the term "contract" in the wrong context. Thanks for your help!

    I've been working temp gigs through various staffing agencies for over 2 years now. I haven't had any problems getting UI during my non-assignment periods.
