    Default 1098 Form, Married but Filing Separate

    my wife and i are joint on the house mortgage, i received a 1098 and her social security number is the ID on it and i am listed as a borrower with her. we have separated in october of 08 so she has not lived in the house or paid any of the mortgage in 2009. also, i am the sole owner of the property.

    my question, is she still entitled to half the mortgage interest? can she also claim the property taxes since they are on escrow?

    i was not able to get a clear understanding from the irs website. it seems like the answer is yes though...

    The person who paid the interest is the person who is entitled to claim it as a deduction on their tax return. It will smooth things tremendously if you could get your mortgage company to report it under your social security number.

    thanks bubba, i could not get the IRS rep to confirm that. maybe they just aren't allowed to advise. how sure are you that this is correct?

    I don't post information unless I am sure it is correct. You can confirm for yourself in IRS publication 936. Page 8 should be sufficient. You can find that at www.irs.gov. You should attach a statement to your return explaining why the interest was not reported on a 1098 under your social security number.

    If you are legally separated, you also might be able to file as single vs married filing separately.
