We gave the landlord 30days notice on August first, moved out mid-Aug, having paid full months rent. He sent us a letter with itemized deductions, stating reasons that he would not be returning our deposit. One of the reasons stated was unpaid utilities (sewer bill). We told him we were fine with that, that since we were moving and had been short of money to please go ahead and take it out of our deposit. Now, Jan 5, I get a letter in the mail stating that the bill wasnt paid, and the city added it to his property taxes. He further states that he paid the bill and expects us to reimburse him for said amout ($130) by Jan 31.
Seeing as we've been moved out this long, can he make us repay him for a bill that he told us he took out of our deposit?
Since we have nothing in writing stating that we wanted him to take the sewer out of the deposit, should we pay it?
