    Default Worried About My Daughter

    My question involves a child custody case from the State of: Indiana. My daughter called me today to secretly tell me she overheard her daddy (who I gave custody to through his attourney not a Judge, due to the best interrest for her at the time) on the phone saying that if something happened to him, he was going to be sure my 10 year old daughter would got to his oldest daughter instead of me. This really upsets me. Can he do that without my say in the matter? Thank you for any advice.

    He can say anything he wants.

    That doesn't mean he will get his way. Typically, the courts look to the child's other parent, should the custodial parent die or become incapacitated. If this is a concern for you, consult with an attorney of your own.

    Thank you for the reply. This puts my heart at ease. I think I will still consult with an attorney because, he has made other threats similar to this one in the past.
