Im planning on marrying an illegal immigrant that entered the country legally but overstayed. She entered the country and overstayed as a minor, but is no longer one. I am a U.S. citizen. I have the understanding that if she leaves the country the 10 year band would apply. My question is, what is the difference between getting married in the U.S.(now as opposed to later) and getting married in her country? We plan on reaturning and/or staying in the U.S. , but I am not sure which method would have her living in the United States legally sooner. What exactly does changing the status based on marriage do for us if we get married while she is still in the United States illegaly? If she reaturns to her country and we get married over there, is there any possibilty of her reaturn with me any sooner than the 10 year minimum? Which method would facilitate our situation, if any at all? Thank your for your time, I find these forums very helpful. I am from Maryland.
