    Question PC Stolen from Apartment During Move-Out and Break Up

    My question involves personal property located in the State of: Pennsylvania

    My Ex and I just broke up. I contacted my landlord and explained I would not be returning as long as the other person was there. The landlord then told me the lease would be cancelled without penalty and the other party would be asked to leave. I left the house and let most of my things remain inside until the other party moved out. It was an abusive relationship. I left for less then 2 weeks and returned when my ex was in another city and my landlord had informed me that all of their stuff had been removed and assured me that they would not be returning. He stayed around while I moved out as well just in case.

    When I returned my Personal Computer was gone. I have not filed a police report yet as am considering giving the other persons family a opportunity to return it. I just looked up the invoice and name is not on the billing address as I used someone else's Credit Card and payed them cash. My name and address is however on the "Ship To" Shipping Address on the Invoice. There has never been any confusion on whose computer it was as I picked it out part by part, built it myself and purchased all the items with my money.

    With this discrepancy will I be able to get my computer back? I do have all the boxes everything came in including all the serial numbers. I also have receipts of some of the components inside the PC such as fans and other items that were not included in the original purchase. I also at the time of purchase registered things like the GPU and CPU, and motherboard. The computer was bought part by part all on one invoice and the cost is over $1600.

    My question in short is: Does my information on the shipping address section of the invoice show proof of my ownership of this property.

    so you think your ex took your computer? You are free to make a police report. I expect that your ex- will argue either that it was their computer or that it was a gift.

    I guess my only choice is to file a police report. I really dont want to get anyone in trouble though. I will have to take it to court and all that I bet. Im wondering if I can get a lawyer to give an oppurtunity to return it before I file, as that may be the fastest way to get it back.

    I went to the police station. The officer took my name and address the P.C. was taken from (My old address) and a short description of the computer as well as the last time I saw it and the exact date I realized it was no longer there. He also took my phone number and wrote it all on a small piece of paper. He told me he was going to begin investigating by talking to the landlord and finding out who else was in the apartment at the time. I did not offer any assumptions on who took it and left it to them to figure out. I did tell him that it was after my ex had moved out that my property went missing but I did not accuse anyone of anything. Should I follow up on this or do you think it will actually be taken care of without any further work on my part? Is what I describe actually considered filing a police report or does that come later?

    Regardless of names on shipping labels or even full blown receipts, in all liklihood police are going to come back and tell you this is a civil matter and that you'll need to take him to court to recover either the computer or the value of the computer. Since you lived together and both had mutual access to each other's things (living together as a couple, but without the protections afforded to you by the legal contract of marriage OR the legal protections afforded via the divorce process), unless police find that some stranger entered the unit and removed the computer, they're most likely to refer you to civil court to resolve the issue if the ex is the "prime suspect". Mr. K is right - the ex will probably argue that it's THEIR computer, and the issue will fall to a judge to determine whose version of events is most credible.

    Thank you very much. It was indeed a HER but thank you none the less. I will indeed take the person to court for this. I realize now how much trust one must have for the person they chose to live with. Its sad so many people have to learn the hard way such as myself. Thank you once again
