    Default Giving Benefits to Some vs. All Employees

    In Illinois
    We have a corp office and 10 satellite locations in Chicago. Can we offer the transit benefit to just the corp staff and not make it available to everyone?

    Yes, that's perfectly okay.

    It's a myth that if you offer a benefit to one employee (or one group of employees) you have to offer it to all. It's quite legal (and not even uncommon) for some benefits to be offered only to full time but not part time; office but not shop; management and up but not supervisory and down; corporate but not field office; and other non-discriminatory groupings. It's only when you get down into protected characteristics such as gender, race, religion, etc., that you run into problems.
