    Default Spouse's Rights to an Inheritance

    My husband and I married in 1997. His parents died in 2000. My hisband and his brother inherited their parents second home on Cape Cod, the house has been put in their names. We are now getting legally separated and I assume eventually divorced. Everything so far is friendly and agreed upon regarding our own home and joint properties. My husband and his brother have also decided to sell the Cape Cod house. I have been given conflicting information as to whether I am entitled to half of my husband's half of this inherited house. I am just wondering if I am indeed entitled to any of his profit from the sale of his inherited property.

    Generally speaking, an inheritance is separate property and not marital property. That can change depending upon the facts of a case and state law. Discuss it with your lawyer.
