    Default Will Did Not Reflect Deceased's Wishes

    My question involves estate proceedings in the state of: Ohio

    Hi, my wife and I were named a beneficiary recently from a family friend who died in October. She left us her car. About a month before she died she told me that she talked with her brother in Denmark (who was to be the beneficiary of the rest of her financial assets). He told her to leave the finical assets to us because he has all he needs.

    The issue is she told me this about 3-4 weeks before she died and said it was already taken care of. The problem is when the attorney sent me the Waiver of Notice of Probate of Will it included a will dated well before she told me this. It stated the original beneficiary of her financial assets, her brother. The case is still open and Im wonder what I should do? Is there a way I can determine where this is going?

    If she didn't change her will, her last will governs.

    if you believe there is another will, you can petition the court to demand the will be produced from whomever might have it but if she really didn't change her will, it is what it is.

    Have you spoken to her brother? Are you aware if she had an attorney that handled her regular business that might have been involved with a new will? Have you spoken with the attorney that sent you the waiver and told him you believe there may be a newer will?

    People can't guess what you have in your head so if you don't speak with them, they are going to go about business as they must, which is follow the only will they are aware of.
