    Default Change in Custody Child Age Laws

    In The State Of Florida I Have Custody Over My Children And I Am The Father. Now My Youngest Daughter Goes For Visitation Like She Is Supposed To At The Set Times In The Divorce Decree. Keep In Mind That The Ex Lives In Ohio About 1,000 Miles Away From Home. Recently Though The Ex Has Been Telling My Daughter That She Can Decide Where She Want's To Live As Long As She Goes To A Ohio Judge And Basically Tells Them What She Want's Even Though The Divorce Was Set In Florida And Florida Laws Are the Only That Apply. She Has Also Been Filling Her Head With Some Age Limit (If There Is One) That The Child Is Legally Allowed To Choose Where She Lives. My Question For You Guys Is What Would Be The Age Limit (If There Is Any) That A Child May Legally Choose Where They Would Want To Live. And What The Laws Are Regarding If A Child Can Just Choose Where They Want To Live Or What That Entails Of.

    I Am Very Tired Of MY Ex Filling My Daughter With A Bunch Of Information That May Not Be True And It Is Very Disturbing Because She Still IS Very Young And Is Being Manipulated And Confused. She Has No Idea What Is Going On And I Would Love A Speedy Response To This So I Can Get This Situation Resolved.

    First, please don't type every word with a capital, it makes it difficult to read. Thank you.

    As you already know, FL has jurisdiction, ex can say all she wants that she will go to court in Ohio, but she will not be able to do that.

    Florida doesn't allow minor children to decide who they live with. Now, of course, ex can file in FL for a modification if she wishes, but the Judge will base the decision only on what is best for your child, NOT what your child says she wants.

    As for ex talking to her that way, there's not much you can do. Even if your court order had clauses in it relating to this, it would be hard to enforce.

    How old is your daughter?

    Sorry, the typing is habit I don't know why i do it.

    My daughter would be 11 but her mind has been so clouded from this it is very hard to get her to see the truth.

    Thank you for your answer. That was what i was hoping it would be. I am very glad to hear she can't really do anything about the situation. I don't think she will come to FL to put in a motion for modification. This really eased my mind greatly.

    I still don't like her saying things to my daughter in the way she does. but none the less i am happy
