    Default Opposing Counsel is Enabling and Ignoring Illegal Behavior

    State of Texas

    The opposing counsel in a Divorce/BKY case is aware of ex-spouse illegal activity, ie; collecting rent on property surrendered to BKY Trustee and refusing to surrender assetts. Is this attorney liable for criminal activity or simply State Bar grievances?

    Probably neither. The attorney owes no duty to you and does not have to explain anything to you. Your attorney should have raised these issues in court if they are significant.

    You are not the client so I don't even think the bar would pay any attention to a complaint from you. Anything to do with a divorce case is also discounted immediately.

    Maybe someone else knows of an angle, but I don't see one.

    You and your attorney are free to bring evidence to the attention of the court or trustee within the context of your legal proceedings.
