    Default What Are The Rules for Bonding Out of Jail

    Here's the backstory of my case: (Florida)

    My question is, if I'm unable to get a court date set and absolutely have to turn myself in.. what are the rules concerning bonding out? I've read before that if you set up with a bondsman before hand, you can be in and out in a matter of hours. Is this true? Is a bond out always an option or just dependent on the judge?

    I believe I could handle that if this is the case, however waiting until trial is not an option.. unless there are other rules stipulating that a mentally unfit person has the option of getting out under a doctor's care. Is there such a thing?

    What are my options here?

    Update: Looked up info in state database and found:

    10/15/2008 CAPIAS ORDERED & ISSUED FOR V.O.P.
    10/15/2008 BOND SET AT $2,503.00

    So does that mean I don't have to wait for a bond to be set & can get out immediately?

    they have the ability and the facilities to treat you while you are in jail. What, you think you are the only person ever that is being treated for something that has to go to jail?



    You really need a lawyer to help you deal with this. Claiming mental health problems as an excuse is not as simple as bringing a doctors note.

    No, I don't.. I realize that I'm completely in the wrong & mental health doesn't excuse me, but I do have a federal ruling that I'm unable to function.. so it's not just a doctor's note. However (at least in the facilities here) I wouldn't get the level of care that I really need - this coming from my doctor who actually goes to the jails to treat patients. I'm hoping that this will matter, but I don't have high hopes.

    What about my questions on this post? Do you have any info on how that works & with the bond already being set, would I need to wait to appear before the judge before being able to be released?

    they have the ability to provide any kind of treatment you might need. It may not meet your private doctors standards but it meets legal standards of treatment.

    so it's not just a doctor's note.
    actually, concerning your specific problems and limitations, yes, it is just a doctors note. The gov makes a determination with a generalized diagnosis. Your specific needs are your doctors place to recommend or list. So, the fact you have a problem is acknowledged by the fed gov but exactly what your very specific problem is is not represented by their acknowledgement. That is what your doctors note is for and so yes, it does get down to a doctors note.



    Especially due to your mental problems, you really need a lawyer. They would be less inclined to deal with you in any way without a lawyer to represent your interests especially due to the mental health argument.

    Different jail systems deal with things in very different ways and pre-arranging bail may or may not be a possibility in your situation and in your area. The only people able to tell you what can happen in your area are the courts and the attorneys that deal with those courts.

    Alright. Thank you for your responce. I guess I should contact the court appointed defence attorney about the bond issue (or would the bonds man know the rules too?) & then look for a lawyer. If the defence attorney is willing to represent me should I stick with them (she has a good relationship with the judge) or would independant council be the better option?

    it's really hard to beat an attorney that has a good relationship (working relationship anyway) with a judge. If you can get the benefit of that for free or a reduced rate, all the better.

    the bondsman may or may not have some knowledge of what you seek but it would not be anything I would rely on. Go with the lawyer.
