    Default Credit Card Fraud During International Travel

    My question involves a consumer law issue in the State of:
    District of Columbia but not sure this applies.

    I was in Prague and an unscrupulous bartender pulled a scam on me. Basically they overcharged my card w/o my permission or consent. They had my card in their possession BUT i never signed a receipt.

    I've gone through the process with credit card company (Citi) and of course the merchant produced FRAUDULENT receipts saying I bought 1 bottle of champagne for $1950 dollars.

    The credit card denied my dispute and said their investigation is over and I owe the $1,900.

    What recourse do I have now? The agreement with Citi states all disputes go through arbitration and initiating party must pay. I can't pay $1500 (for starters) for arbitration.


    They credit card company says I cannot invoke "Unathorized Use" because the merchant had my card in their possession and have all the relevant information.

    Any help would be much appreciated. I simply will not pay the $1,950 the credit card company.

    I feel this is "unauthorized use" and falls under those laws as I never authorized the charge, and the merchant forged documents back to the credit card company.

    Is there legal grounds for "unauthorized use", and should I pursue in small claims?

    You can try making a report to the authorities in Prague, although I can't promise that they'll be able to do much of anything to help you.

    Antigone wasn't diplomatic about it, but your credit card company is going to hold you responsible for the charge even if you refuse to pay.

    I didn't feel diplomacy was necessary since the OP clearly stated that he simply would not be paying that bill.

    Of course I realize the credit card is going to hold me liable.

    My question is do I have any other legal recourse? My agreement says I can take Citi to small claims court so I'm considering doing that.

    I feel this falls under "unauthorized use" of my card, and I'm only liable $50

    You are so lucky!! let me guess, it was called Champagne Bar, very nice attached to Vinothek Ungelt, right behind the Cathedral in the center.
    Same happened to me. I now have over $5000 in dispute, actually, they tried to pull over $15000 but luckily the credit card had a limit of $7k at that time. Unfortunatley, the credit card company does not want to take any responsibility. I do have recepits but they are copied transactions from earlier.
    I went tp the Police in Prague and they said that they have 2 to 3 claims against that bar since the last 9 month but can't proof anything yet. Supposedly the bar belongs to Russians. I think you were lucky as well as the police told me that they have undercover video from the bar where some powder is being put into drinks. I would say let's be glad we are alive!!
    Anyway, I think you should fight this as well. It seems to easy for the credit card companies to keep blaming customers. Have the bank proof to you that you indeed authorized the transactions.
    If you want, I can give you the name and address of the authorities in Prague if you need some statementt about this bar and the practizes there, although I assume that someone in the government has to benefit from this scam, why would they let this bar do this for so long?
    After I presented everything to my credit card company, the answer was " no news to us"
