Default Theft of a Client List

Is it illegal or can I be sued for going into a dumpster and retrieving an unshredded client list or sales receipts and then calling the clients to offer at a cheaper price? My competitions manager has called to let me know that a couple of his customers have called to return some orders. He is accusing me of buying a list from one of his ex employees that are under contract, and that he is going to get a TRO on me at the court house, but if I will tell him who sold me the list he will not persue any further. Do I have any concerns here?

Did you buy the list, or did you get lists out of your competition's trash?

Your competition's privacy rights will depend upon state law. Most states view the owner as having abandoned any privacy rights in items they put out with the trash.
