    Default Manslaughter While Intoxicated

    My question involves criminal law for the state of: Texas. My son was in car wreck He crossed over and killed 3 people a father and 2 of his children the other 2 we treated and released. He is indited on 10 counts. His lawyer is court apointed I have talked with him very little. I am getting a copy of the discovery papers. Can anyone give me an idea of what he is facing if found guilty? What can I do to help his case.

    The best person to speak to is his lawyer. Obviously these are inflammatory facts, and his prior record will be a factor.
    Quote Quoting Texas Penal Code, Sec. 49.08. Intoxication manslaughter.
    (a) A person commits an offense if the person:
    (1) operates a motor vehicle in a public place, operates an aircraft, a watercraft, or an amusement ride, or assembles a mobile amusement ride; and

    (2) is intoxicated and by reason of that intoxication causes the death of another by accident or mistake.
    (b) Except as provided by Section 49.09, an offense under this section is a felony of the second degree.
    A second degree felony carries a potential penalty of two to twenty years in prison and a fine not to exceed $10,000.

    As you can imagine, the community where this happened will not take this lightly. We can't know what the outcome will be, but my guess it will not be the minimum allowed.

    I'm very sorry.

    Everyone loses in this situation.

    Christina Thank you for your reply. Im lost here. Had lots of heartaches here but this one is more than I can take. I know I am going to lose my son. I made so many mistakes with him. When this happen I took a friends advice and used tuff love. God forgive me for turning my back on my son. I have two sons, the other one will not let me be a part of his familys life he gave me a choice to walk away from his brother are not be involvedin his familys life so now I have lost two sons.

    Thank you Mr Knowitall. Yes we live in a very small area my grandkids went to school and daycare with the children that died. I pray for the family but I know their pain is so bad. I'm lost I hardly leave my room and my days are filled with pain and crying nothing in my life will ever be the same as well as the people he harmed. I'm really not sure what will happen after this is all said and done.
