    Default Is It Possible to Request a Change of Trial Date

    My son has a trial date for Jan 4. I will be out of the country at that time and planned on representing him. (he's just turned 18 but was 17 at the time of the infraction).

    Is it possible to get the trial date changed and if so how do you do this?

    Unless you're a lawyer, you can neither represent him in court nor will your absence from the country be relevant to his court appearance.

    Ok got it, but is it possible for him to change his trial date? It is during school time and he graduates early (end of Jan). He cannot miss one more day of class or they will drop him from the class.

    His attorney can ask the court for a change of date.

    If the court says no, however, he should plan on appearing.

    Yes, in court... he should plead not guilty and ask for an attorney.

    However, if he is a minor, your income will be considered in his request.

    so you are saying he should go to court to request a change of court date? that defeats the purpose of what he is trying to do, i.e. he can't make that court date. How does he request a change of court date prior to his court date? Is there a way to do this?

    oh i reread your reply... i see what you were saying....i wasn't suggesting he request a lawyer... what i meant is that "can he request a different court date"

    but your comment about requesting a lawyer... i never thought of that, he doesn't have any income to speak of, he's 18, are you saying he can show up at his trial date and request a court appointed lawyer.... or should he request that before the date? he could certainly use one

    If this is for an "infraction" (which is what you described it as in your first post) then he does not qualify for a "court appointed attorney"... he would have to hire his own (as in pay for a private attorney as opposed to have the court provide him the services of a public defender).

    And yes, when he appears for trial on Jan 4th, and assuming he is not ready to proceed, he can ask the court for a continuance. however, that does not, bby any means suggest that the judge has to grant him with one. he may be ordered to proceed with trial on that same date.

    You need to be a bit more clear with your posts instead of just your short bursts. I am still unclear as to whether he is out of the country, you are out of the country... or what!!!
