My question involves a security deposit in the State of: Massachusetts
I'm living in a 6 person apartment, only 3 of which are on the lease (myself not being one). When I moved in in September of 2008, I paid a first, last, security, and realtor's fee ($825 each), which I have a signed receipt from one of the lease signers for.
I told them at the beginning of Dec I would be moving out on January 1st, and would be putting my room up on the market.
Now this is where it gets complicated. As I was posting the room for rent, the rest of the roommates decided they all wanted to move and rent the apartment as a whole, which, in my opinion was fine, it just meant I was not liable to find a replacement.
Long story short, one of the roommates found a friend to rent out my room, but feel that until they rent out the whole apartment, I'm not due my security. Now, if I leave my room as it was found for the new renter, no matter how long she's actually going to be there, is it not the new tenant's responsibility to cover the security deposit, or the very least, the renters that are on the lease?
What are my rights here?
