    Default Shoplifting at K-Mart

    My question involves criminal law for the state of: Florida.

    I was caught shoplifting at KMart. I am an adult. I was taken to the back room, and signed an agreement stating I was caught shoplifting. They told me that if the amount was under $15 I would be able to go, and if it was above I would be arrested. Thankfully, it was less than $15.

    They took my SS#, my address, and looked at my license. They told me that in a few weeks I would receive a letter in the mail, I take it the civil demand letter, and will have to pay a fine of approximately $100, and to never come back, and don't do anything stupid. They were incredible nice and respectful, even making jokes. Nonetheless I was crying and regretful.

    Fine. Now I am worried and wondering.

    1. Am I going to be charged with anything?
    2. Is this going on my record?
    3. Is this going to affect my ability to get a job?
    4. If put on the criminal database, how long do you remain on this list and/or is there a way to know if you are on it, or a way to get yourself off of it?
    5. If I am charged it would be 2nd degree petit theft. How long does this stay on your record and can it be cleared?

    Thank you, and I won't be shoplifting anymore.

    - For right now, no. But bear in mind the store does have 1 year to file Criminal Charges.

    2. Is this going on my record?

    We can't say for sure. Some stores will put a shoplifters name into the National Retail Theft Database, and it can be found during Criminal Background Checks. Keep that in mind if you should apply for Retail jobs. And it can make it more difficult if you apply for a job that involves handling cash, credit cards, etc.

    No one knows for sure which stores use the National Retail Theft Database. Those who do know (LP people) will not say. I think (don't quote me) that you are on the list for atleast 5 years (can someone with more knowledge answer that one??)

    It would be on your record for years, depending on your states laws.

    PS: The No Trespass warning likely includes Sears stores as well.

    Criminal charges remain on your record permanently, as in, for the rest of your life.

    Depending on state law, you *may* be able to get certain charges expunged after a few years (how many, assuming you can do it at all, is state specific), which will limit who can see it. Also, in some states, employers may only *see* x years back. But this is not like a credit report, where after x amount of time it rolls off as if it were never there. Criminal charges do not go away.
