    Default How to Get My Roommate Out

    My question involves real estate located in the State of: Georgia.
    I signed a lease with a roommate and things have started to go sour. We have lived together for over a year. We re-signed the lease in 07/09, so we have about 7 more months on the lease. My roommate is NEVER there, maybe four or five times a month at most. Because of this, the door to that room is always locked and none of the other tenants (myself and children) cannot get to the laundry room. I've been going to the laundromat (which is expensive and with kids I have a LOT of laundry!) because according to my roommate "it's not my problem because I'm not there." Also, when we moved in, we agreed that I would take care of all utilities and the roommate would pay cable/internet/phone bill. This wasn't in the lease, but has been the agreement for over a year and a half. Because the roommate is never there, they cut the home phone off and cut the cable and internet down to the bare minimum because "why should I pay for something I'm not using? besides, I can't afford it." I can't exactly cut off the lights and water because I have trouble paying the bills - I find a way. The roommate gets full use of the utilities when they are there, I don't restrict usage like they are doing to my family.
    I now have a roommate who I'd like to replace the old one with. This roommate would pay all bills (rent + cable/internet/phone) with no problem and no complaints. How can I legally get the old roommate OUT?!?!?!?!

    Just a quick addition to this post...I came home yesterday to find the roommate's "other half" (who does NOT live there, pay rent or any bills, and should not technically have a key) came into my house without anyone being there to take some of the roommate's belongings to another house. That's fine; I am upset about the fact that this person came into MY HOUSE without my permission and without the roommate being there and brought other people to help them move stuff (furniture that we agreed would be used for everyone, such as a dining room table, a pantry shelf, etc) and basically threw everything on the floor for me to clean up. I AM SO UPSET!!! HELP!!!!

    You get your roommate to agree to be released from the lease, then get your landlord to approve the new replacement roommate (something I would assume the lease requires, but you can read the lease to see what provisions it contains for subletting).

    You are upset that the roommate that you want to move out appears to be doing exactly that, but isn't leaving his furniture behind?

    No, not at all, I'm upset by the fact that the person who took the furniture is NOT on my lease, does NOT live here, does NOT have a key given to him by the landlord, and does NOT have permission to be in MY HOUSE without his girlfriend (the roommate) being present. The furniture being gone is simply annoying - the fact that he came into my house while no one was home, brought other people to help him (who are also NOT on my lease and are NOT tenants) is what bothers me. Who knows what else is missing that I have not noticed yet? Also, if the roommate refuses to be replaced on the lease, is there any legal way I can make her do that?
