    Default Alienation of Affection

    My husband and I moved to Florida about a year and a half ago to put our marriage back together, and was successfully doing so. The neighbor, a 22 year old woman and supposedly my best friend began spending alot of time at our house. Each time she visited she would put herself in closer contact with my husband. He didn't realize what was happening until it was too late, and they ended up having an affair. We almost split up, the kids have been devastated, but we are slowly working it out. Can she be sued for alienation of affection and criminal conversation since he had stopped showing affection to both myself and our three daughters during this affair?

    There are very few states that still allow these types of lawsuits, and Florida does not.

    Florida Statutes 771.01 Certain tort actions abolished.--The rights of action heretofore existing to recover sums of money as damage for the alienation of affections, criminal conversation, seduction or breach of contract to marry are hereby abolished.

    I highly doubt your husband was blindly forced into the affair. If you want money I say divorce the cheater and get alimony.
