    Default Search Warrant for a Computer for Unrelated Offenses

    At my house, it was served a search warrant, due to an investigation relating to my mom in something about real estate ownership fraud, forging of a signature suspicion.

    On the search warrant it says to take computers (to look at Email and IM communications and Any records), anything to establish identification (they took a passport and PG&E bill) and grant deeds purporting to deceased owner.

    It also stated that:
    [x] it was used as the means of commiting a felony
    [x] it tends to show that a felony has been commited or that a particular person has commited a felony.

    It did not check it tends to show sexual explotation of a child... or anything else other than that.

    I have child pornography on that computer, and I am a 17 year old. Will they do anything to me if they were to find it? It has already been 44 days since the warrant has been served. Are they going to do anything? Would they have already done something to me?

    Also 12 days after the warrant, a person and a sheriff came to the house, I was expecting them to talk about the computer, but they interviewed my mom and asked questions about the will and grant and who is the person that signed it. We haven't heard from them since.

    You can count on them finding your child porn.

    they just haven't gotten there yet.

    Why yes, they can charge you with a crime they find while looking for evidence in another crime.

    Did you think they couldn't?

    When can I expect them to come?

    Sorry for the gross nature of this post. I've always been this way ever since my brother molested me at a young age and shown me CP.

    I've been severely depressed and attempted to kill myself recently. I just wanted to know if they really were going to come. I'm sorry..

    No one can say what WILL happen, only what MIGHT happen.

    It is possible that they will not bother to look at any graphic images unless they are thought to be scans of documents related to forgery or ID thefts matters. But, it is a possibility they will find it and come to talk with you or mom.

    I also sincerely suggest you get some counseling immediately.

    Thank you cdwjava and cyjeff. I am going to the doctor and getting counseling this monday or tuesday, but I don't think it will help in any way.

    You might be surprised how much help it can be. You have to give it time, and you have to be willing to let someone help. If you go into it thinking there is no way someone can help you sort out your own victimization, you are doomed to continue down the path you seem to be on. If you truly have feelings for children and think it is as a result of your own molestation, you need to seek that help before you become that guy who did this to you ... and the cycle will go on and on.

    Another point to ponder is that the child porn can be pinned on your mother. You'd have to stand up and take the punishment and you'd also have to show that your mother knew nothing of your illegal pictures/videos.

    Finding child porn incidental to an fraud investigation is chargeable. But wait till the police do accuse before you admit it is there. There is a mighty slim chance it won't be discovered.

    CDWJAVA suggested you get some counseling. I concur. Your addiction will only get worse as time goes on. And eventually, kids who were molested sometimes become molesters themselves. And you do not want to pass this horrible pain to someone else because your pain will not go away and then you will add to it a victim's pain as well. Good Luck, and please do get the help.

    So I'll just have to wait for them to come? I will go get counseling but what good will that do if I'm just going to be branded as a potential sex offender anyways? I feel as though my life is already over before it even began.

    It will make you feel much better about yourself. And being a minor in your circumstances a judge may be much more inclined to be lenient. You have a good long life to look forward too. I have a friend that committed a sex offense when he was young like you. After he was charged he plead guilty to sex with a minor. He was 20. He received 3-5 years in prison but the judge suspended it all as long as he went to sex offender therapy. Which he did. 3 years later he finished the classes (one class once a week) and graduated. After 5 years he applied to have all his rights restored and received them. Rights including voting, firearms, everything, and as a present for good behavior he was let off the sex offender registry. Today, he is married, owns his own home, has a child of his own and a college education. He also has a good job counseling others that were like him. Think of what is happening as a door to a better future with no addiction and a normal life. That is what you have to look forward too.!
