    Default Threatened With a Drug Charge Over an Employee's Stash

    My question involves criminal law for the state of:Michigan

    Heres the situation. I was pulled over for speeding ( i am guilty ) and was informed that my employee to my right had a warrant for poss of marijuana. We were promptly removed from the truck and were searched. I had nothing illegal on my person nor did my passenger, but they did find his stash, located in the center lower console, on or near his side. The cop was extremely upset, thinking I had known about the stash and had not told him. Anyway, they ended up charging my employee with the violations pertaining to his warrant only. The cop threatened to charge ME with poss of marijuana and obstruction of justice!!! I am as clean as a preachers sheets, 37 years old, business owner, vet, ccw holder, and my employee is a habitual offender with 6+possession charges. Do I need to get a lawyer? Are they sending the weed to the lab or something? Will these charges surface in a week or two, or is this over? I have not been able to sleep over this. Should I go to the sheriffs office and see if a warrant has been issued and offer to turn myself in? Really Lost here, any help greatly appreciated.

    How did he manage to stash his drugs there without your knowledge? Your employee denied ownership?

    We cannot tell you if they will actually follow through and charge you, or (if they are planning to do so) what they are waiting for (although if they do intend to charge somebody, drug lab results would be a decent bet). You may want to contact a lawyer, and have your lawyer check with the prosecutor to see if a report has been submitted to them and, if so, how they intend to proceed.

    Legally, anything in the car is the responsibility of the driver.
