    Default Would We Also Lose Our Deposit

    Hello. I'm in the state of Colorado.

    My boyfriend and I moved into a house, and signed a year lease with another couple. There are still 6 months left on the lease, but things haven't been working out. We collectively decided to move out, and sublet our house. We have already talked things over with the landlord, and he is fine with us subletting, he just would like to meet and approve the subletters. Our house has been in the classifieds for a couple of weeks, and we have gotten some calls. One seemed promising, and he told us how much he liked the place and that he thought he definately wanted it. We told him to talk it over with his roommates and get back to us. The next day my roommates rented a uhaul and packed everything of theirs and moved it 500 miles to a storage unit in the town where they plan to move. We have not heard back from the potential subletter, and the phone calls have stopped coming. My boyfriend and i are worried they are going to bail. We put down a deposit and last month's. Total, with last months rent, it comes out to a loss of $500 a person. They dont care about getting it back at this point, since they have pretty much already moved and are ready to leave. But my boyfriend and I care! My question is, if they break their lease agreement, but we uphold ours, could we still be screwed out of our deposits?

    Presumably you're all jointly and severally responsible for the rent on the apartment, in which case any unpaid rent would be deducted from the deposit before any remaining balance is returned.

    I figured as much. I think I might just give our landlord a heads up if things seem to keep going in that direction. Hopefully, they don't. Thanks!
