About a few months back I had a telephone to harass case got it dismissed after diversion program...Thought it was all over till I get a letter from Tempe for another incident 4 months later. See this is what bothers me, my first telephone to harass case was in July for an incident that happened on 12/19/09. This next incident happened on 4/3/09...The case for the first incident did not occur till sometime in june or july. Either way I see info about the 4/3/09 reference in a police report in both tempe and mesa harassment case.
So is there a possibility to get this charge dismissed if there is a slight hint of evidence suppression??
Next up is a harassment case in Mesa basically the same person this garbage all happened last year. The pubic defender put in a rule 11 and I'm waiting to go to that next week. I went to the arraignment in mesa and spoke to the judge and just wish I had plead no contest to the charges and stuck with it and didn't feel confused because that earned me 2 more trips back to court only to find out the court wanted jail time.
The questions I have right now are these. If this rule 11 hits the fan, is there anyway I can get less jail time, the way I see it is jail is inevitable if the rule 11 fails. Me personally I know the only option is to get into military service but that is on hold because of the misdemeanors. Me personally I just think this is lame because this is all verbal, no threats no physical damage inflicted but yet both the prosecutors in mesa, and tempe want jail. Should I try to avoid supervised probation at all costs?? I also plan to only plead no contest if the plea bargain is a joke.
The original plea bargain in mesa before the rule 11 was 20 days in jail 1000 dollar fine and 2 years supervised probation.

The plea bargain in tempe which was put out but could not be executed because of the rule 11 was 2 years supervised probation with mental counseling and no longer returning to the community college where the person resided...then she just non chalantly couldn't figure out whether or not she wanted jail or not, I ended up getting a public defender anyways because I figured she was gonna be silly and change her mind.
Whatever help would be appreciated but either way I feel like I'm looking at jail time, when I wish they would just hand me a fine.
