    Default Reentry through student or fiancée visa after deportation

    I'm a German citizen, in February 2005 in entered the US on a 3 months tourist visa as a visa waiver. I overstayed my visa. I applied for college, I was planning to leave voluntarily once I got accepted to apply for a student visa in Germany. Unfortunately before I got the answer from the college I applied to, in February 2006 I got arrested by the INS and deported. It says in my deportation documents, that I can't re-enter the US for the next ten years. I have a boyfriend in New York, he's a student, who's visiting me in Germany, but I'd like to know whether there is any chance, that I could return to the US before 2016, either for visit, on a student visa or maybe if I marry my boyfriend. Thank you for your help.

    You would have to get a special dispensation. Given your apparent intention to try to return to the U.S. on a long-term basis, you may wish to consider working with an immigration lawyer.

    I am still waiting for the answer of the college in NYC that I applied to in January 2006, I'd want to go back to the US on a long term basis ONLY if I get accepted for that college. If not, I'm going to study in Germany and would be interested in having the possibility to visit my boyfriend in New York. How big/small is the chance that I'd get the permission from the American Counsel in Germany to do so? If I could prove that I'm a student in Germany, hence have no plans to overstay again...but rather finish my education in Germany...also if I got married to my boyfriend, that would be primarily to make our situation easier in terms of me being able to visit him too, instead of knowing that thats impossible for a long time.

    thank you. I forgot to write that my boyfriend talked to a lawyer already, who said the chances are very slim that I'd get a special dispensation at all, in both cases: reapplying for a long-term AND short-term stay. What do you think? Should I still try? Would I need a lawyer in both cases?
