    Default Probation for Domestic Violence and Received a Traffic Ticket

    My question involves criminal law for the state of: California

    Please let me know if it is possible for the probation officer to find out about the traffic ticket which was driving on a suspended license and driving without insurance ? Does the probation officer's computer system have the obility to find out about my traffic tickets. I have traffic court in 3 months for a misdeamor and infaction. I would like to not tell him and just get a fine and start paying the fine with no problems with my probation officer. I'm affraid to tell him because he might violate me.

    When you commit new crimes, you should expect that your probation officer is going to find out.

    How does he or she find out about the new crimes ? This is traffic and from my understanding traffic files are separate from criminal files.

    A lot depends on the structure of the county, the nature of the computer systems, and how often the probation officer pulls people's contacts and whether the local system has a set up to include flagging people's names.

    I suspect that you will find that your probation requirements include reporting any police contact. Failure to do so could result in revocation. And, you can pretty much guarantee that if this goes to court as a misdemeanor, that the DA will contact probation and advise them of the situation since he will also be seeking your probation record because the DA will find out you are on probation when he runs your record.

    If Probation finds out by way of the court or the DA you can pretty much guarantee that you will be violated.

    Yes, if you advise your P.O.of the situation you might be violated. Or, he might think you are being forthright and upstanding. On the other hand, if he has to find out the hard way, he'll probably show up at work or home and haul you off to jail.

    Of course, you can always hope to be very, very lucky.
