    Default Lying About Income

    My question involves child support in the State of: Michigan
    I have recently found out that my child's father is hiding his money. He works for his parents and they pay him cash before a payroll check is cut. On paper he makes little money. I have requested child support be recalculated but his income taxes show the same thing. How can I prove he is lying about his income? He claims the child every other year on his taxes and he actually gets more back when he claims him than he pays in child support for a year.

    You may not be able to get him on the cash because there may be no way to prove it. Does he receive any thing from his parents like free rent/housing, cars, etc...? You can look into in-kind income. Also, maybe tax returns from before he was served with child support papers may be able to help your case proving that up until this case was established he was receiving more income and then coincidentally he now receives less despite his parent's business doing just as well then before the case. You need to search case law on this one.

    Why haven't you asked FOC to impute income to him? Or did they decline to do so at an earlier hearing?

    I'm sorry, I do not know what you mean. He started working for his parents after he started paying child support and his income has declined slowly each time I request an income investigation. I want to file a moion but I want to make sure I have all my ducks in a row. I did find our he wrote a $5,000 check from his personal account to buy a blazer. I find this very frustrating. I know I need to get a lawyer to look into his bank account but I do not have the money for a lawyer.
