    Default What Happens During Emancipation

    My question involves emancipation laws for the State of: California

    Alright well I've been looking into becoming emancipated for quite some time now. I've done some research and before I fully decide to begin the process I'm looking for someone to represent me in court as well as answer my questions beforehand. I also have some concerns about the process before I seek out legal counsel and pay for such. My three concerns are;

    1.) Many sources state that one must already be living on their own before beginning the process. If my parents are in agreement and I can show proof that I have found a place in which I can live do I need to move out immediately before I begin the process or may I wait until the judge has made the decision to approve or deny my request for emancipation?

    2.) In the past I have been in some trouble. I have changed though and can get letters of recommendation and other proof stating so. With this being said, do I even have a chance?

    3.) Last but most defiantly not least, will social services be involved in any way in the process? I've had experience with social services and would not care to deal with them in any way if it can be avoided. So if some of the reasons brought up in court during the process would normally be reported to social services because of the fact that I am a minor, if I am denied emancipation will social services then become a part of my life again? I would really hate to be put back into foster care and not be able to live with my parents because a judge denies me.

    You can live anywhere your parents allow you to live.

    It is best if you are already living there... on your own.

    Probably not.

    You make it sound like your criminal record happened 5 years ago.

    How long ago was your criminal record? If it was less than 2 years, don't bother going another step. If it was less than 5, I would still just stay where you are.

    You will have to give a reason for the emancipation.

    If denied, your own testimony as to that reason may be passed along to social services.

    I guarantee that any involvement that you have had with social services will become part of the process.
