living in virginia, Hi after almost a year of being sober I and my bf got drunk, which was a bad decision. things got completely out of hand. At some point i fell off the stairs not due to him and i broke my arm. when the ambulance came also the police. they kept asking if it was my bf who did it and i said no or i cant remember what happened during the day. i had so many black outs. nevertheless they charged him with abduction &assault as a felony (there were never any weapons). The investigator approached me several times i told her that i can't remember the events, that i was drunk, that i know for a fact that he didnt broke my arm, he didn't abduct me as i was able to go outside smoking etc. i told her i was not voluntarily going to testify. she got angry with me. this was last week. my bf is still in jail, his lawyer is trying to see about a bond hearing if it all will be granted. Today i was served with subpoena from commonwealth. I called the lawyer and he said that that is normal standard procedure . is this true. i know the prosecutor can go ahead without me, though i said if im going to testify, i just cant remember, if i said anything at the time that i was drunk (they know that as i took a bloodtest), what can i expect. i think it is unreasonable to have him charged for abduction, as it is clear that wasnt the case. there were no weapons involved, tt did became physical , and there are bruises on both me and him. He has no history or was ever charged with battery, assault, me neither. he does have a dui and a second now as he tried to escape in the car. i dont have any former legal issues.
