    Default Legitimate Medical Issues Can Work for Shoplifting Charge

    About 2 months ago I was charged with Grand Larceny (over $200.00) for pushing a cart full of groceries out of a Kroger's without paying.

    I have severe ADD, which I am on medication for, and did not pay because I got distracted and forgot.

    I had plenty of money to pay for the items, but the store refused to take any payment, and filed criminal charges.

    Today I went to court, and my attorney managed to get the case "nolle prossed".

    The prosecutor decided not to proceed with the case, mainly because of a letter written by my physician, because he thought the evidence against me was weak, and also because I had no prior criminal history.

    So I just wanted to let folks know that having a LEGITIMATE medical condition COULD possibly mitigate your shoplifting charge, especially if it's a first offense.

    By the way, I'm in the state of Virginia, and I'm 47 years old.

    I am extremely happy to hear of your outcome. This is both because of the outcome itself and the fact that I feel that some members of this board appeared more interested in chastising you than in providing useful advice.

    And to clarify my position, I consider shoplifting to be a very large problem and I believe that shoplifters should be dealt with very severely. But, there are cases which on the surface appear to be shoplifting, that really are not. Yours appeared to me to be one of those exceptions.

    For PandorasBox I would add, it really isn't a driving issue. There are people on every highway in the country legally driving with driving skills more impaired for other reasons than this situation would cause.

    She might forget to check her blindspot before turning into a lane? That's more likely than forgetting to pay for a cart full of groceries don't you think?

    I, on the other hand, am appalled that a precedent has been sent that will allow still more people to find a way to avoid responsibility.

    cbq: Thankfully, I've seen some states where the law states that mental illness, drug and alcohol usage cannot be used as a defense.
