My question involves a consumer law issue in the State of: OR
Buyer is located in: CA
Facts:
I had let my roommate play the World of Warcraft account which is under my name and later without my permission he sells it.
I find out he sells it and wish to reclaim it. He also received payment on a paypal account which we share which happens to be under my name.
I contact the buyer and tell him that my roommate sold the account without my permission and I will be taking back the account and refunding his money.
Buyer says he will sue me for fraud because he resold the account for an additional ~$350.
The payment he sent to the paypal was listed as a "gift" and my roommate tells me the guy runs an account reselling business. Im not sure if there is any record of the sale at all.
So my questions are: Am I liable to pay for his ~$350 in lost profit, or is my roommate? Are there any other charges he could bring against either of us? Could he bring charges in CA or would he have to come to OR?
