    Default Relative Roommate Agreements

    My question involves an eviction in the state of: North Carolina

    I have an apartment with everything in my name, the rent, the cable, the electric. My older brother has been staying with me since I rented this apartment in April 2009. In October he paid his share of the September bills to me late. Since then he hasn't paid anything. On Nov. 12 I told him he needed to pay up or get out but didn't set a date. 2 weeks later on the 22nd I told him he needed to pay up or get out by the first. On Friday the 27th I disconnected the cable/internet because he hadn't paid. He called me at work and cursed me and threatened me. When I got home I called the police to escort me inside. Everything went fine. Also, when the police were here I told them about what was going on and they said that if I asked him to leave with them here and he wouldn't that they would take him to jail. By Sunday evening I realized that he wasn't here and that his door was locked with a knob requiring a key. I called almost daily the only contact number I had, with no answer. On Friday I changed the front door locks. Later that evening I received another call at work saying that I couldn't do that. He has bothered me off and on since last Friday about if I was going to change the lock back, give him a key to the new one, or not let him back in at all. I don't want him here, but I will gladly allow him entry to get his belongings. Can I do that or do I have to allow him to continue to live here rent free? Also, I talked to a lawyer today and they said that he had no rights since I was offering to let him get his stuff. Please help me asap. Thanks

    In Texas an in many states, YOU CAN'T KEEP SOMEONE FROM ENTERING THIER HOUSE without going to court. I don't think the police can do a thing about this. This is a civil matter and POLICE can't intervine on your situation? On what charges will he be going to jail? For not paying bills?

    Heck if I know, that is just what the police said. For trespassing perhaps?

    Really, given that he was paying you to stay with you, you made him into a tenant and should have evicted him.

    "Later that evening I received another call at work saying that I couldn't do that" - from whom? Your landlord? The police? Your brother?

    Have you told your brother yet that you don't want him to move back in?

    I received the call from my brother. The landlord doesn't care as long as I give them a copy of the key. He left for a whole week contacting me after my Pay or Quit Notice. I thought he was gone, I didn't know if he took his stuff or not til they day I changed the locks because when I did that I also removed his key lock knob off of the door to his room. I have told him I do not want him to come back, he said I have to let him. But, as I said he left after the notice and didn't talk to me for a whole week.
