    History: I have a 10 year suspended felony sentence. Never been in "trouble" before, this is my only offense. In 3 years, I have never missed an appointment but once before when I was hospitalized in ICU. I used to have a great officer, but was changed to a different one 6 months ago.

    In the beginning of Nov my son and I became violently ill with 104 temperatures on the morning of a scheduled appointment. After a Drs visit and a H1N1 scare - I got a few shots and sent home on tamiflu and other prescribe meds. Two days later when I was feeling better I called my Probation officer and left a message asking for a return call and a breif explanation of what happened. 2 days later after no return I called again, No return call. A week later he called, I told him I was extremely ill and have the Drs note and all my prescriptions to show I was truly ill(since they don't prescribe tamiflu unless you are VERY sick) and had no way of contacting him since I was incoherent. He said there was no openings in the last 2 weeks of Nov and since I was sick I should keep my germs at home. I called back leaving a message at the end of Nov wanting to see about scheduling a Dec Appointment. He then calls on Dec 1st saying if I can make it to the office in an hour he will give me a Dec appointment, otherwise i don't get one! I live in the country and have a 1 year old, don't drive, and my sons car seat was in his dad's truck, who was at work, so I couldn't call a cab, nor are kids aloud at the PO office. There was no way I could make it in an hour, even if I tried walking there. He said he was going to claim I had another failure to report. I then ask about Jan. He tried to not schedule one for Jan too, that they didn't schedule that far in advance, but I convinced him to give me one, over the phone.

    How come he doesn't have ANY openings for Dec when it was only the 1st?

    I know he's trying to get me in trouble. but WHY? I'm planning on calling the office director, or is there something else I can do. I'm transferred out of a different country, should I call the administrator of my original county?

    Someone help I haven't done anything wrong, I've followed all the guidelines set by the judge. I've already taken all my classes and went to counseling. Not to mention all the money I've spent, for him to deny me an appointment and claim I didn't report.... I'm on a suspended sentence so this will mean I have to go to prison for 10 years!

    Probably because a lot of people take vacations in December. It's a busy month.

    A typical flu resolves within three to seven days of onset. I'm not sure why you would still be "extremely ill" about two weeks after you were infected, but from what you say I'm sure you have doctor's records to back that up. Keep them safe, and be prepared to submit them to your probation officer or, if necessary, the court.
